🇮🇹 Italy: Yes. Italian law requires the presence of a notary or a Chamber of Commerce official to safeguard public trust during the winner selection and prize allocation phases. As established by Article 9 of Presidential Decree 430/2001, these authorities must draft an official report documenting all operations. Without this supervision, the draw and prize assignment are considered invalid, exposing the promoter to penalties. In the case of instant win promotions, this certification is issued by the technology platform provider.
🇨🇭 Switzerland: No. Swiss regulations are more streamlined, but for transparency and a Growth by Design approach, we always recommend a certified procedure.
We coordinate closing reports and prize draws with Chamber of Commerce officials or notaries, ensuring complete impartiality.
🇮🇹 Italy: Yes. Article 10 of Presidential Decree 430/2001 requires companies promoting a prize contest to submit a prior notification to the Ministry of Enterprises and Made in Italy (MIMIT). This notification, which includes the official contest rules, must be filed electronically through the impresa.gov.it portal at least 15 days before the promotion starts.
🇨🇭 Switzerland: It depends. Many promotional contests do not require authorization if there is no disproportionate purchase requirement. However, if the prize value is high or the mechanics include elements of chance similar to gambling, the Federal Act on Gambling (LGD) may apply.
We manage the regulatory differences between DPR 430/2001 (Italy) and LGD (Switzerland), handling ministerial notifications, official rules, and financial guarantees.
🇮🇹 Italy: The promoting company acts as a withholding agent and must pay a 25% withholding tax on the value of the prizes, as established by Article 30 of Presidential Decree 600/1973. In addition, the VAT paid on goods and services purchased as prizes is not deductible for the company, representing an additional cost.
🇨🇭 Switzerland: TA withholding tax (35%) applies only above certain thresholds (typically 1 million CHF for licensed games). For smaller promotional contests, the rules are different and often more favorable.
We support you in calculating the full tax impact (withholding taxes and VAT) so the budget you plan is the budget you actually spend.
🇮🇹 Italy: The server running the software that manages prize allocation (including draws, instant wins, etc.) must be located in Italy. If participant data is collected on foreign servers, a mirroring system or a secure, traceable transfer to an Italian server must be implemented before the prize assignment phase. This procedure must be documented and technically certified so it can be presented to the notary or Chamber of Commerce official.
🇨🇭 Switzerland: Data must comply with the new Federal Act on Data Protection (nFADP), which is similar to the GDPR but includes specific provisions on criminal penalties and obligations to notify breaches without delay.

In Italy, Article 10, paragraph 5, of Presidential Decree 430/2001 states that prizes that are not claimed or not assigned—except those explicitly refused—must be donated to a non-profit organization (ONLUS) or another charitable entity. The beneficiary organization must be specified in the contest rules.
In Switzerland, the management is more flexible but must still be defined in the rules to avoid disputes. We support you in selecting the beneficiary organization or in drafting the appropriate recovery clause.
