Do you have specific technical needs?

Do you need a notary public?

🇮🇹 Italy: Yes, Italian regulations require the presence of a notary or Chamber of Commerce official to protect public faith during the stages of identifying winners and awarding prizes. As stipulated in Article 9 of Presidential Decree 430/2001, these figures must keep minutes of all operations. The absence of such supervision renders the draw and award operations null and void, exposing the promoter to sanctions. In the case of Instant win this certification is issued by the manager of the technological platform.

🇨🇭 Switzerland: No, Swiss law is more streamlined, but for transparency and "Growth by Design" we always recommend a certified procedure.

We coordinate closing minutes and draws with chambers officials or notaries, ensuring total impartiality.

Do we have to ask for prior permission?

🇮🇹 Italy: Yes. Article 10 of Presidential Decree 430/2001 stipulates that the promoters of a prize competition must send a prior communication to the Ministry of Enterprise and Made in Italy (MIMIT). This communication, containing the contest rules, must be transmitted telematically through the portal impresa.gov.it at least 15 days before the start date of the event.

🇨🇭 Switzerland: It depends. Many promotional contests do not require authorization if there is no "disproportionate" purchase requirement, but if the value of the prizes is high or there is a gambling-like element of chance, federal law (LGD) comes into play.

We handle the differences between DPR 430/2001 (Italy) and LGD (Switzerland), dealing with ministerial communications, regulations, and deposits.

Who pays taxes on premiums?

🇮🇹 Italy: The promoting company acts as a withholding agent and must pay a withholding tax at the rate of 25% on the value of prizes, as required by Article 30 of Presidential Decree 600/1973. In addition, VAT paid on the purchase of goods and services intended as prizes is nondeductible for the company, representing an additional cost...

🇨🇭 Switzerland: There is a withholding tax (35%) only above certain thresholds (usually CHF 1 million for authorized games, but for smaller promotional contests the handling is different and often more advantageous).

We support you in calculating tax charges (withholding and VAT) so that the planned budget is the real one.

Where should participants' data reside?

🇮🇹 Italy: The server on which the software for awarding prizes (including draws, instant win, etc.) runs must compulsorily be on Italian territory. If the collection of participants' data takes place on foreign servers, a mirroring system or a secure and traceable transfer of the data to an Italian server must be implemented prior to the award phase. This procedure must be documented and expertly documented to be made available to the notary or chamber of commerce official.

🇨🇭 Switzerland: Data must comply with the new DPA (nLPD), which while similar to the GDPR, has specifics on criminal penalties and "without delay" notification requirements.

Our systems ensure data mirroring and full compliance with the Swiss nLPD and the European GDPR.

If someone tries to hack the contest or uses fake receipts?

If a user uploads the same receipt twice, or a receipt modified with Photoshop, the system instantly discards it. We also cross-reference data such as IP, phone number, and play pattern to stop "serial contestants" before they make a dent in the prize pool.

How do the prizes come to the winners?

We manage the lifecycle of the premium 360°. From purchase (sourcing) to storage in our warehouses, to final shipment. We use couriers integrated with our platform: the winner receives automatic tracking and we manage customer care in case of missed deliveries. You only see the report of awards delivered in dashboard.

Do we have to handle participants' disputes?

No. We provide a dedicated support service (via ticket, email or WhatsApp) that answers questions about rules, game mechanics or shipping status. Your marketing team remains focused on strategy, not complaint handling.

Unallocated or unsolicited prizes, what happens to them?

In Italy, Article 10(5) of Presidential Decree 430/2001 stipulates that unclaimed or unassigned prizes, other than those refused, must be donated to an ONLUS (Non-Profit Organization of Social Utility) or other nonprofit organization. The beneficiary organization must be specified in the contest rules.
In Switzerland, the management is more flexible but must be defined in the regulations to avoid disputes. We support you in choosing the entity or drafting the clawback clause.
